Motorcyclist banned for impaired driving
A Southampton man who admitted he rode his bike having drank too much and then blacked out was banned from the Island's roads for 12 months.
Freedmont Swan, 27, was caught by Police on Saturday at 3.05 a.m. at the junction of Front and Parliament streets in Hamilton. Yesterday in Magistrates' Court Swan, of Camp Hill, said: "I don't even remember all that I just woke up in the Police station."
Senior Magistrate Archibald Warner replied: "If you had too many drinks that you don't remember anything that is not a defence."
The court heard that Swan was riding his cycle in the eastbound lane on Front Street and was spotted by Police swerving over the central yellow line.
He was asked to pull over and officers noticed he had trouble getting off the cycle, was unsteady on his feet and was unable to put the bike on the stand.
They could also smell alcohol on his breath and noticed his speech was blurred and eyes were glazed.
Swan was asked how many drinks he had that night, and replied: "Too f***ing many."
When officers took him to Hamilton Police Station and demanded a sample of breath he refused and told them: "I am the richest man in Bermuda. I am a billionaire. I am not giving you any breath."
Yesterday he admitted to refusing a breathalyser test, but denied the more serious offence of drunk driving. He told the court it was his daughter's birthday and he had gone out drinking with some friends and got "a little carried away". "I am just trying to put across I am not a bad man," he said.
Mr. Warner fined him $1,000, ten demerit points and banned him from driving all vehicles for 12 months.
