Probation for man who violated child’s privacy

A man who was seen outside a bathroom window while a girl prepared to shower was sentenced to two years’ probation this week.

Dwyer Booth, 36, admitted intruding on a child’s privacy when he appeared in Magistrates’ Court in March. He was sentenced for the offence yesterday.

The Paget resident suggested that the victim, who cannot be identified for legal reasons, take a shower before Hurricane Humberto struck Bermuda on September 30.

The girl covered the bathroom window with a towel after seeing Booth outside while she was preparing to shower.

Prosecutor Adley Duncan highlighted Booth’s early guilty plea and that his social inquiry report showed a low risk of reoffending.

He suggested that Booth be sentenced to jail or probation for the offence.

Bruce Swan, Booth’s lawyer, said the intrusion did not involve physical contact or “prolonged interaction” with the girl and requested that his client be granted a conditional discharge or probation.

Booth apologised for his actions before being sentenced.

Magistrate Maria Sofianos ordered Booth to not commit another offence, stay away from drugs and complete 100 hours of community service during his probation.

Ms Sofianos also ordered Booth to participate in “empathy-building” programmes and not leave the island without permission from his probation officer.
