Woman is cleared of harbouring former fugitive Omari Gordon

A woman who rented the apartment where fugitive Omari Gordon was found has been cleared of harbouring him from justice.

Magistrate Khamisi Tokunbo said the evidence against Davina Ratteray, 44, was "so weak and tenuous" it did not support the charges she faced.

Police arrested Gordon, 27, at premises in Sound View Lane, Sandys, on January 7 this year after a 13-month manhunt.

He allegedly fled after firing shots at Police officers in Middletown on November 29, 2008, and has since been charged with firearms offences, which he denies.

Ms Ratteray was also arrested after Gordon was found. She reportedly told Police she rented the apartment for a friend and turned the lights on for someone.

She was charged with obstructing justice and conspiracy to obstruct justice, which she denied.

Her trial at Magistrates' Court heard last Wednesday how she began renting the apartment in July 2009 and continued paying for it until January 2010.

Landlord Gloria Joell, who lived above the premises, told investigators Ms Ratteray paid the $2,000 monthly rent in cash, but was rarely seen there.

A Police search of the apartment revealed a cell phone and Belco bill in Ms Ratteray's name, addressed to the apartment.

The electricity company's records showed Ms Ratteray, of Store Lane, Devonshire, had been paying the bill since July 2009.

Investigating officer Detective Sergeant Jason Smith arrested the CableVision employee at her job.

He told the court he received a phone call at one point during the investigation, from a man in Jamaica, Eugene Ascento Grant.

Mr. Grant, also known as "Fields", told him he was Ms Ratteray's boyfriend and that she had no idea Gordon had moved into the apartment.

"He told me that she rented the apartment for him. He used it to take other women [there] for trips," Det. Sgt. Smith said.

"He said one of Omari's friends asked if he could stay for a bit, and he told him 'cool'. He said Ratteray did not know what was going on."

Ms Ratteray's lawyer Charles Richardson asked Magistrate Khamisi Tokunbo to dismiss the case due to a lack of evidence against his client.

"The only thing proved is that Ratteray paid the rent and the power bill. She had no idea Gordon was there, and there's nothing to contradict that. Police can't even say how long he was there. He had been on the run since November 2008, but the apartment was rented in July '09. Where was he before then?" said Mr. Richardson last week.

Arguing for the case to continue yesterday, prosecutor Maria Sofianos said there was enough evidence against Ms Ratteray.

However, asked by Mr. Tokunbo what there was to prove the "friend" Ms Ratteray rented the apartment for was Gordon, Ms Sofianos conceded there was nothing.

She said Ms Ratteray answered "no comment" during Police interviews, so the only evidence was what she said after her arrest about renting the apartment for a friend.

Mr. Tokunbo then asked: "Where's the evidence she was helping Omari Gordon?"

Ms Sofianos replied: "She was paying rent on an apartment where Omari Gordon was found."

"That doesn't make her harbouring him," replied Mr. Tokunbo.

Clearing Ms Ratteray of the charges, the Magistrate said: "There's no evidence of harbouring Omari Gordon other than that he was found at the place. No evidence of how long he was there."

Ms Ratteray, who had been on bail throughout, left court without comment.

Mr. Richardson said after the hearing that there was nothing to show she even knew Gordon.

"There was never any evidence. They found him in the apartment on the day he was arrested. There was no evidence that he was there any other time," he said.

Omari Gordon was charged with shooting at Police yesterday, after 13 months on the run.
