?I thought I was getting lucky?

A New Jersey man told a Supreme Court jury that ?something in my heart? made him end intercourse with a Florida woman he had met while out drinking earlier this year.

The man claimed the woman was ?fairly intoxicated? when he introduced himself to a group of women at The Beach bar on Front Street.

In Bermuda to accompany a friend for a job interview ? and possibly find work himself ? the man said the 39-year-old woman dropped her shot glass on the floor and proceeded to drink his. The 38-year-old told the seven-man, five-woman he told the victim?s friends that she needed attention and needed to go home. He denies sexually assaulting the woman on April 3.

At that point he said the victim?s host invited him and his friend back to her house to continue the party. In the car, the woman was ?moaning sexually? in his ear and moving her hands on his groin area. There were three other people in the car.

Once inside the host?s home, the alleged victim went into a back room while the rest of the group discussed politics, travel and living in Bermuda.

After a while, he began dancing until his friend pulled out $1 bills. He said he went around the room dancing for everyone, adding: ?(It was) Good clean fun, that?s all it was.?

The defendant said the group split into two and then he got up to use the bathroom.

?I went into the bathroom, did my business and when I opened the door there was (the alleged victim) standing there in her bra and underwear?.

He said she grabbed his shirt and pulled him into the room on the bed, adding: ?At that point, I thought I was getting lucky.?

They engaged in foreplay before having intercourse. ?The minute that we started I knew things weren?t right. Something in my heart ? I believe it was my wife ? took a hold of me and said I shouldn?t be here with this woman,? he said.

The man claimed that he is ?not sure? if he ejaculated.

With a lot of emotion he told the jury that he could not believe that he was cheating on his wife.

The defendant said that he went into the living room despite the victim?s pleas for him to stay with her.

He said that he could not figure out how to tell his friend ? who is also a good friend of his wife ? that he had cheated.

?How do you tell some girls you just met you had sex with their friend?? he said.

The defendant told the jury that he had been ?trapped? in Bermuda for three months and this was his first opportunity to tell his side of the story.

He said that the victim came out of the back and told everyone that he had groped and fondled her.

He said that he was shocked and confused at the allegation and was told to leave the house before he could explain himself and was angry that his friend would not let him back in the house.

He said that they left and went home and he awoke to find three policemen in his room.

?They made me strip down naked, took my clothes, handcuffed me, took me to the Police station and threw me in a holding cell,? he said. ?If I would have known that when I left the apartment she would have called the Police I would have never left and called the Police myself.?

Crown counsel Paula Tyndale began her cross examination by asking the defendant if he had ever been involved with drama, suggesting that he was lying during his testimony.

Ms Tyndale suggested that the defendant had ample opportunities to tell his story before he left the apartment.

?It is not true that today is the first time for you to tell your story,? she said.

Ms Tyndale also suggested that the defendant went after the victim because her friend was giving him the attention he wanted.

?I?ve been married for 20 years with three kids and have a beautiful home. I didn?t come here to have sex with anybody,? the defendant said angrily.

Nurse Gaynell Hayward who examined the victim after the alleged sexual assault said that there was no bruising, tears, scratches, bite marks or any other suspicious marks.

The trial continues today before Puisne Justice Ian Kawaley.
