Mother of murder victim hits back at AG?s claims

The mother of murder victim Rebecca Middleton has hit back at claims by the Attorney General Larry Mussenden that Bermuda?s legal system worked in handling that case.

No one was convicted for the brutal 1996 killing of 17-year-old Rebecca at Ferry Reach.

One of the suspects ? Kirk Mundy ? was given a five-year sentence after pleading guilty accessory after the fact while Justis Smith was cleared of murder after the judge ruled there was no case to answer.

Senator Mussenden told Wednesday?s Senate: ?The result might not have been what everyone wanted but the system was used and the system worked.?

But last night Cindy Bennett (pictured), Rebecca?s mom, said: ?Nothing came out all right. There is still a murderer or two out there.

?I know the damage and hurt that has been done to our family.?

She said if lessons weren?t learned a similar legal botch up could affect a Bermudian family next time. Opposition House leader John Barritt said: ?If ever there was a case where the system failed this is surely it.

?With hindsight now everyone accepts there was a rush to judgment.

?Then you have a no case to answer judgment by the presiding judge.

?It?s time to give it up and admit the failures.?

Mr. Barritt wants Government to amend the Court of Appeal act to allow the prosecution to appeal no case decisions.
