In 1992, a coroner's jury found the youngster's death at King Edward VII Memorial Hospital was "aggravated by a lack of professional care''.

Justin, the son of Mr. Eddie Fisher and his wife, top athlete Jennifer Fisher, died after he stopped breathing in the recovery room and went into cardiac arrest following routine surgery.

He was revived and kept on life support for several days, before being declared brain dead.

It was the second time in a year a coroner's jury had pinned part of the blame for a patient's death on the care received at the hospital.

The death of Bermudian entertainer Ms Wendy Wilkinson following a bike crash had also been "aggravated by a lack of professional care''.

Last night Mr. Hume Martin, executive director of the Bermuda Hospitals Board, confirmed he had received a writ of Justin's death. But he did no know the amount of damages being sought.

"I am not aware of any detailed information. Our lawyers will be responding to it when that information becomes available.'' Mr. Martin said the hospitals board would be represented by Appleby, Spurling & Kempe.
