Magistrate dismisses medicine argument

Kenneth L. Wright, 42, of Farm Lane, admitted having in excess of 80 milligrams of alcohol in 100 millilitres of blood, but denied being impaired.

Wright told the court that at noon that day he drank two beers, but before Police stopped him on Middle Road, Warwick, he had also consumed some Vicks Formula 44-D cold medicine.

An alcohol test showed that Wright had 111 milligrams of alcohol in 100 millilitres of blood.

"The cold medicine contained alcohol and I think it would have given this type of reading,'' Wright said.

Magistrate the Wor. Cheryl-Ann Mapp asked Wright if he really believed the story he was telling her. He said yes.

Mrs. Mapp fined Wright $400 and disqualified him from all vehicles for 12 months.
