Witness saw female stab Hill with metal object

A witness to the murder of Kellon Hill yesterday said she saw a teenage girl stab him in the chest, causing him to collapse bleeding.

Kennysha Simons, 18, contradicted her earlier evidence under cross-examination by John Perry QC, who is defending Kellan Jeurreau Lewis.

She admitted she saw Zharrin Simmons, a 17-year-old girl, stab the teenager with "a metal object".

Asked why she did not tell the court this earlier, she replied: "Because it seemed like it didn't matter. What difference would it make?"

Lewis, 18, is accused of murder and being in possession of a knife on August 9, 2008. He denies the charges.

Mr. Hill, 18, died from a stab wound to the heart after trying to retrieve a gold chain which Lewis allegedly snatched from around his neck.

The alleged murder took place at a leaving party for 14-year-old Crenisha Joyiens at Elbow Beach, attended by up to 100 teenagers.

Lewis attended with Miss Simmons, Gary Hollis, 16, and another teenage boy understood to be Devon Hairston, 18. They were also joined by Kevin Warner, 19.

Yesterday the jury heard evidence from three teenage witnesses in the case.

In the morning there were dramatic scenes as a woman in the public gallery started shouting at Mr. Perry during his cross-examination of prosecution witness Diondea Symons.

"You can't tell him what he saw," she shouted, prompting Chief Justice Richard Ground QC to say: "That lady needs to leave now."

Mr. Justice Ground told the jury: "That outburst was completely unacceptable.

"Obviously in a case like this there are going to be strong emotions. There are family, relations and friends on both sides. But the whole point is, you being the jury, you should be insulated from them and come to a calm, objective understanding of the facts."

The woman was reprimanded by the judge, who told her: "It's not for members of the public to interfere with the processes of the court, no matter how right they think they are. Otherwise the whole thing breaks down. It is not acceptable."

He barred her from the courtroom for the day, and warned her: "Any further outbursts from you and I will punish you with contempt of court, and that means prison. And believe me I will."

"I apologise," she replied.

Yesterday, Supreme Court heard evidence from Tionae Jones, 18, of Warwick. She said Mr. Hill swung a motorcycle helmet at Mr. Hollis, but she did not see the fight.

However she said afterwards, Miss Simmons, Mr. Warner, Mr. Hollis, Mr. Hairston and Lewis all ran "down the beach".

The court also heard from Diondea Symons, 18, of Southampton, who travelled pillion to the party on the back of Mr. Hill's motorcycle.

When the friends decided to leave, he said Lewis grabbed Mr. Hill's gold chain from around his neck.

"We started riding up the hill real slow and then that's when Kellan Lewis grabbed Kellon's chain, up the hill. It broke off," he said.

"Kellon ran off the hill to get his chain back. He said, 'Kellan give me my chain back'."

He then saw Mr. Hill backing up the hill, chased by Mr. Hollis, whom he grabbed hold of and asked: "What are you doing?"

He then saw Mr. Hill lying on the ground. Mr. Symons said he did not see Lewis after the chain incident.

Miss Simons, of Warwick, then gave evidence. She said she saw Lewis grab Mr. Hill around the neck and they began throwing punches at each other. Other boys then started fighting Mr. Hill and Miss Simmons joined in, "fist fighting".

Miss Simons claimed she did not see any weapons.

"I don't know what stopped it (the fight)," she told Crown counsel Rob Welling. "Kellon dropped to the ground. He was bleeding."

Mr. Welling asked: "At the time he fell were Kellan Lewis, Gary Hollis and Zharrin Simmons still fighting him?"

"Yes," she replied.

Under cross-examination by Mr. Perry however, her evidence changed.

"You didn't see Kellan Lewis stab Kellon Hill did you?," said Mr. Perry.

"No," she said.

"But you saw who stabbed Kellon Hill, didn't you?," he said. "Did you see someone with a metal object in hand hit Hill in the chest area?"

"Yes," she replied.

Mr. Perry then read from Miss Simons' Police statement, in which she said: "When that was done Hill dropped to the ground."

"Who did that, who hit Hill in the chest area causing him to fall again and was thereafter bleeding," he asked.

"Zharrin," she replied.

"Why did you not want to tell us that before?" asked Mr. Perry.

"Because it seemed like it didn't matter," she said. "What difference would it make?"

The lawyer then read out her statement in which she said: "Zharrin came out of the blue as it were and stabbed Kellon Hill."

"That's right isn't it?," he asked.

"Yes," she replied.
