Driver banned for a year, fined $1,550 after early morning traffic stop
A man with a bad driving record landed back in court for driving drunk with his radio turned up too loud.
To make matters worse, Jamal Simmons, 29, was already meant to be off the roads for speeding at the time he was caught by the Police. Simmons pleaded guilty to impaired driving, driving while disqualified and "playing a car radio where it could be heard more than 30 feet away" when he appeared at Magistrates' Court on Thursday.
Prosecutor Nicole Smith told the court that Police spotted his grey Opel car overtake another car on Burnaby Street at the traffic lights on junction with Front Street in the early hours of Sunday morning.
He then stopped the vehicle in the middle of the pedestrian crossing prompting the Police to pull him over on Front Street.
The officers noticed that Simmons, of Pain Lane West, St. George's, appeared to be drunk.
However, when they asked him if he'd consumed alcohol, he replied: "Are you for real? You're a joker. I'm not drunk, I only had two beers."
He later gave a breath test, although the results were not specified in court.
Police inquiries revealed that Simmons was subject to a previously-imposed driving ban spanning the period July 10 2009 to October 8 2010.
According to Senior Magistrate Archibald Warner, this was for two offences of breaking the 35 kph speed limit once by driving at 89 kph and on another occasion at 98 kph. He hasn't paid his fine for the 89 kph offence yet.
Simmons told the Magistrate: "Sorry for my actions. You won't see me here again."
However, he complained that he needs his driving license because he has to get to work by 7 a.m., lives alone, has three children and has "a lot of things to take care of".
An unsympathetic Mr. Warner replied: "Then you should be careful how you drive."
He meted out a total of $1,550 in fines, a 12-month driving ban and 20 demerit points.
