Man gets a fine for swearing at cop
A 29-year-old man received a suspended sentence of three months imprisonment after pleading guilty to using offensive words on more than one occasion.
David Noel James of Bostock Hill East, Paget appeared in Magistrates' Court yesterday for using offensive words after being arrested.
The court heard from Crown counsel Cindy Clarke that early Saturday morning Police on patrol in Somerset noticed James banging on a window at a residence on Scott's Hill Road.
Officers noticed that his breath smelled strongly of alcohol and his speech was slurred.
James was arrested because of his outstanding warrants for failing to appear in court in August of 2005 for another offensive words charge.
After he was handcuffed James yelled, "F**k you, you dirty a** foreign cop." He was taken to Somerset Police Station where Police noticed that there was blood on his shirt. He refused medical treatment.
James said that although he did use offensive words, he did not say anything until after he was arrested, where James said one the officers "roughed me up unnecessarily."
"He threw me up against the car and he busted my chin. Then I started acting a fool," James said.
He added: "There was blood all over the car. I had to get stitches, I have bruises all over."
Senior Magistrate Archibald Warner asked: "Why should I believe you when clearly based on your previous convictions you've done this before?"
James' previous charge of using offensive words related to an incident on August 11, 2005 where he followed another man into Hamilton Police Station and told the man, "You stole my f*****g money."
He was then warned about his language by Police and taken outside where he continued yelling obscenities.
James failed to appear in court for that charge and was arrested on Saturday as a result of his outstanding warrant.
Mr. Warner said: "Based on what you're saying, you think you can do what you feel and act the way you feel when you get a few liquors?"
James also has a previous charge from 2003 of assault against a female.
Mr. Warner fined James $1,000 and handed him a 90-day imprisonment sentence suspended for a year. For his second count of using offensive words James was fined $800.
