Pembroke man found guilty of sexual assault
After just one hour of deliberation yesterday, a Supreme Court jury found a Pembroke man, who had entered a woman?s house and had sex with her while her daughter slept beside her, guilty of sexual assault.
Kaream Tsun Gibbons, 29, of Rambling Lane, was found guilty of the assault which occurred on November 14, 2005.
Gibbons had previously pleaded guilty to trespassing on the same date.
Over the course of the trial, the four-woman, eight-man jury heard that at roughly 4 a.m. on the that date, the victim awoke to find a man in her bed ?pumping in and out? of her.
While she originally thought it was her ex-boyfriend, the victim realised it was not and pushed Gibbons off of her and started yelling at him.
She told the court that Gibbons was known to her but that they had no prior sexual relationship.
Gibbons, who appeared without legal counsel throughout the two-day trial before Chief Justice Richard Ground, claimed that the sex had been consensual and that the woman had only ?freaked out? after her three-year-old daughter had woken up.
He told the court he went to her house after a night of drinking and he admitted the victim could have mistaken him for someone else.
After the verdict yesterday, Chief Justice Ground ordered that a social inquiry report be prepared prior to sentencing.
He also told Gibbons that he has a right to appeal the case, despite appearing unrepresented.
Gibbons was remanded to prison until his next appearance in court at the September arraignments session.
