Ex-girlfriend was ?straight up violent?, defendant told Police

The St. David?s man accused of forcefully taking his ex-girlfriend to his home and sexually assaulting her told Police he was the victim in the relationship.

?She is just straight up violent. I am the victim here,? he said in a Police Statement taken the day after the alleged attack.

The man, represented by lawyer Elizabeth Christopher, has denied charges of unlawful assault occasioning bodily harm, depravation of liberty and sexual assault for the May 26, 2004 incident.

The man alleged that the woman had a violent tendency throughout their relationship and recalled three unrelated incidents where he claimed his ex-girlfriend was violent towards him ? and one time sliced him across the fingers with a knife.

He told the five-woman, seven-man jury they would fight and then resume sexual relations afterwards.

?Two days later we had seen each other and talked about the incident and we had slept together, [we had sex?.

During cross examination, Crown counsel Carrington Mahoney suggested to the accused he was lying about his ex-girlfriend being violent towards the man and said: ?I am going to suggest to you that you were just making up that incident.?

Mr. Mahoney asked him: ?As far as you are concerned this is a mad woman who keeps running for a knife to cut you. Do you consider her crazy??.

On the day of the alleged incident the man and his ex-girlfriend had a heated argument over the phone after he heard a male voice in the background to their conversation and after he alleged she was ?double-dating? she hung up on him.

He told the court: ?Sometimes I want to talk and sometimes she hangs up the phone in my ear ? that is disrespectful.?

According to her testimony, he showed up to her house and hit her on the side of her head, knocking off her helmet, however the man described the incident as a ?scuffle? and said he was just trying to stop her from hitting him.

He said: ?I just tried to calm her down and I had to put her on the bed,? and added: ?By her trying to stand up I knocked her in the nose. Just a little bit of blood came out and when I saw the blood I was worried ? I was shocked ? that?s when I let her off the bed?.

While in her testimony she alleges she was dragged to the car, taken to his home and raped, the man said she got into his car on her ?own free will?.

He also said she did not show any disapproval with him having sex with her and told the Police: ?I slid off her pants, she didn?t say anything. Then I slid her underwear off slow ? she didn?t stop me or anything.?

The man said the woman moaned during sex but recalled that after sex: ?she didn?t say anything at all. She was just giving this dull look?.

The man alleged he was shocked when he was arrested and charged and said: ?I had called [my ex-girlfriend. I had asked her is she going through with this ? I was shocked ? and she had answered me yes.?

The case continues today.
