Prosecutors yesterday closed their case against two men charged with the double murder of Haile Outerbridge and Ricco Furbert.

Christoph Duerr, 26, from Sandys, and Le-Veck Roberts, 21, from Warwick, have both been charged with the premeditated murders of the two men, who were shot dead inside Belvin’s Variety on January 23, 2013.

Mr Roberts is also further charged with attempting to kill Zico Majors on January 16, 2013, in the Khyber Heights area of Warwick; taking a vehicle without consent on the same day; and taking a vehicle without lawful authority on the day of the murders.

One firearm was used in both the attack on Mr Majors and the murder of Mr Outerbridge and Mr Furbert.

Prosecutors have alleged that Mr Roberts was the gunman in both shootings, while Mr Duerr is accused of storing and supplying the weapon used, however Mr Majors himself told the court that Mr Roberts was not the man who shot him.

Witnesses to the Belvin’s shooting testified to seeing Mr Furbert opening the store’s front door as if to leave before running back inside shouting: “They’re outside, they’ve got guns.”

Both he and Mr Outerbridge ran to a store room in the back of the building, but were followed by a gunman wearing a black, full-face helmet and blue clothing. Several shots rang out, and the gunman fled the scene, leaving the victims dying in the store room.

CCTV footage of the shooting revealed “darker tones” on the gunman’s right hand. While prosecutors have suggested the tones match tattoos on Mr Robert’s hand, a forensic imaging expert accepted in cross examination that darker tones could also be caused by shadows, smudges or skin pigmentation.

The court heard that Mr Roberts was arrested for the murders on January 25, 2013 by armed officers responding to a report that a vehicle believed to be linked to the shooting was on the property where he was staying. A single particle of gun shot residue was discovered on the back of his left hand, along with several particles associated with the discharge of a firearm.

Mr Roberts was initially held in custody before being released on police bail. In July 2013 he was released from police bail and subsequently flew to Atlanta, Georgia, using his US passport.

He returned to the Island on August 31 last year after being extradited from the US, and was turned over to Bermuda Police at the LF Wade International Airport.

Police raided Mr Duerr’s home on January 28 after receiving information from a witness that he had two firearms stashed beneath his bed.

Mr Duerr fled the home, but a search revealed several bullets while photographs of a silver revolver dated August 2012 were found on his computer.

Mr Duerr turned himself in at the Somerset Police Station the following evening.

The jury heard a Police interview with Mr Duerr dated May 31, 2013, in which the defendant admitted occasionally holding firearms for other people.

He recalled an incident in September 2012 in which Lorenzo Stovell was shot dead near Woody’s Bar.

He told officers that he was in the bar before the shooting, but left with a girl and only heard the gunshots when they were on their way back.

Mr Duerr said he was later given a firearm.
