CedarBridge manager's firing still in dispute
A dispute over whether CedarBridge Academy had the right to fire a manager for refusing to sign a school contract has yet to be settled.
Bermuda Public Services Union general secretary Ed Ball Jr. said a date for a court hearing had not yet been decided on.
He expected one would be set soon.
Busie Ible was sacked hours after a court order was filed preventing the school's board of governors from dismissing staff who refused to sign contracts which would allow them to be fired at any time.
He was the school's manager of information systems.
An injunction was launched in Supreme Court last Monday at which time Puisne Judge Ian Kawaley told the school board they could not fire managers who refused to sign the new contracts.
Mr. Ible was fired and the board was summoned to court to determine whether or not it had breached the order the following day. The matter was adjourned for a week to allow the board to file affidavits.
The chairman of the board of governors is George Scott, chief organiser of the Bermuda Industrial Union.
Government Whip Lovitta Foggo is the deputy chairman and CedarBridge's principal, Kalmar Richards, is a board member.
Mr. Ible's lawyer Venous Memari argued last week that the order was breached as soon as the school's operations manager, Stuart Crockwell, handed her client termination papers.
But CedarBridge's lawyer, Michael Smith, described the proceedings as "draconian".
Mr. Ible discovered he had been sacked after he was unable to log into his CedarBridge e-mail account from home.
The Bermuda Public Services Union (BPSU) member had been off sick that day.
He went in to work to try and gain access to his account and discovered he was locked out of his office. Minutes later, Mr. Crockwell handed him the pink slip.
