Pushing bike can lead to fine
be found guilty of impaired driving, a Magistrate said on Friday.
Gladstone Butterfield, of Horseshoe Road, Southampton was fined $350 and lost his licence after pleading guilty to refusing a breath test on October 17.
Crown counsel Charmaine Smith said Police saw Butterfield pushing his bike on Rockland Estate Road in Warwick at 10.30 p.m. She said Butterfield was attempting to start his cycle.
Police asked him if he was all right, to which he replied that he was fine and was only trying to get home. Police said he appeared to be drunk and he admitted he had had a few drinks.
Police demanded a breath sample which Butterfield refused. In court, he said he thought that pushing the bike was allowed.
However, Senior Magistrate Will Francis told him that he was not supposed to have the bike in his care if he was intoxicated.
