Recaptured man questioned over several incidents
A man who was accidentally released from the Westgate Facility a month ago has been caught and is now assisting Police with numerous investigations.
Crown counsel Carrington Mahoney told Chief Justice Richard Groundthe Supreme Court was now in a ?peculiar situation? because Police wanted Kevin Leroy Butterfield to remain in their custody instead of going to Westgate.
He said that since being apprehended, on Wednesday, Butterfield has been assisting the court .
?What started out as him assisting with an investigation of one incident has now turned into him assisting with 30,? he said.
He went on to explain that Police felt if he was remanded to the Westgate facility it would be ?harder to access him?.
Butterfield is awaiting a trial for allegedly robbing Nelson Pavao of cash, cheques and a TV on May 25 of last year and was remanded in custody after initially being bailed until his trial.
Prison staff allowed Butterfield to walk free on May 15 of this year, not realising that his bail had been revoked and he was awaiting a Supreme Court trial. He then failed to show up to his July 17 trial and a Police search was launched.
Justice Ground questioned if he could legally order that. After law books were consulted it transpired that Justice Ground could order him to be remanded and then Police would then make the request to prison officials that he be moved to Police custody.
