Murder accused man made 'beat up' comment, court hears
A teenager accused of murdering 18-year-old Kellon Hill told others that night that "somebody is going to get beat up", a court heard.
The prosecution yesterday outlined their case in the first day of the trial of Kellan Jeurreau Lewis.
Lewis, 18, denies killing Mr. Hill and being in possession of a bladed article <\!m> a knife <\!m> in a public place on August 9, 2008.
The Crown says the teenager went out that night deliberately looking for trouble.
Mr. Hill, a college student, died from a stab wound to the heart after trying to retrieve a gold chain which Lewis allegedly snatched from around his neck.
The ensuing fight is said to have involved four other teenagers one of whom, it is alleged, also stabbed Mr. Hill with a screwdriver. A post-mortem however, revealed the fatal wound was caused by a knife.
The alleged murder took place at a party for a 14-year-old girl at Elbow Beach.
Opening the prosecution's case, Director of Public Prosecutions Rory Field said: "Kellan Lewis had gone to the party armed with a knife and his attitude that night was that someone was going to get hurt."
Mr. Field said even if the jury could not conclude whether Lewis delivered the fatal wound, if they thought he abetted another to kill, then he was equally guilty of murder.
"There is one defendant in the box but the prosecution is saying that aside from the defendant there were several other persons involved to a greater or lesser degree," said Mr. Field.
"If you find one of the other attackers delivered the stab wound but that Kellan Lewis was in there attacking the victim and that he enabled or aided that other person to kill, then he would still be guilty of murder."
Mr. Field said Lewis was among a group of teenagers from White Hill, Somerset, who attended the party. He travelled there by bus with Gary Hollis, 16, Zharrin Simmons, a 17-year-old girl, and another boy, understood to be 18-year-old Devon Hairston.
They were joined there by Kevin Warner, 19, whom the prosecution claims was carrying a cane.
Mr. Field said the group was drinking alcohol and acting aggressively. The fatal fight took place in the public access road to the beach, Tribe Road 4B, as Mr. Hill was about to leave at 11 p.m.
"Kellan Lewis went up to the victim with Gary Hollis and grabbed his gold chain and tore it off him," said Mr. Field.
"Kellon Hill then got off his bike wanting his chain back. Gary Hollis attacked Kellon Hill and he was then set upon by the other four members of Kellan Lewis' group."
Mr. Field said Mr. Hill was hit with a motorcycle helmet and beaten so hard in the back of the head with a cane that it broke.
"During the attack Kellon Hill was stabbed by Kellan Lewis to his chest area with a knife. There is evidence he was also stabbed with a screwdriver."
This is alleged to have been carried by Miss Simmons.
Mr. Field told the jury: "The fact Zharrin Simmons is not in the box is in no way letting Kellan Lewis off the hook for the part he played."
The court heard that after Mr. Hill collapsed bleeding, the teenagers ran off to the beach. An ambulance was called but the 18-year-old died at 12.29 a.m.
Yesterday, Supreme Court also heard evidence from a teenage girl at the party. Tionae Jones, 18, travelled to Elbow Beach with a group of friends and cousins, one of whom was Kevin Warner, whom she said carried a cane.
At the party Lewis appeared "kinda drunk". Miss Jones said he told her, "All these guys round here, somebody is going to get beat up".
