Lawyer complains about Facebook Fugitive's shackles

Runaway prisoner Alvone Maybury's lawyer complained his client was shackled hand and foot during a court hearing yesterday.

Magistrate Khamisi Tokunbo was not aware Maybury was in chains until lawyer Llewellyn Peniston expressed concern.

"I ask that they take these shackles off this man. He's surrounded, he can't move," said Mr. Peniston in reference to nine Police officers and four Corrections officers present in court.

"I don't think it's consistent with justice, or the fairness of justice."

Mr. Tokunbo told the prison officers: "I didn't know he was shackled and I'm concerned about that because I was approached by your department."

The Magistrate said after he'd asked if it was necessary to shackle Maybury, he'd been told he would not be shackled.

"I'm surprised he's in court this morning that way," he said, asking the officers to remove the chains.

Maybury earned the nickname the "Facebook Fugitive" after allegedly bolting from two prison guards outside Magistrates' Court on July 13.

He was leaving court after being charged with possessing a gun in Pembroke last December, discharging a shot from the gun, and possessing a number of 9 mm live rounds.

He was found by the Police two weeks later hiding in a shed in Pembroke, and now faces additional charges of escaping lawful custody.

Maybury has not been required to enter a plea, as the case must be dealt with by the Supreme Court.

Following the preliminary hearing yesterday, Mr. Tokunbo remanded him into custody. He will appear at Supreme Court for arraignment on September 1.

Meanwhile the Magistrate told the guards they could put Maybury's shackles back on before they took him away to Westgate.
