Plea for clemency pays off

Acting Senior Magistrate Archibald Warner accepted the appeal by duty counsel Maxane Anderson while 24-year-old Arron Bean waited to be transferred into HM Prison's custody yesterday.

Bean had just pleaded guilty to resisting arrest, assaulting a Police officer with intent to cause bodily harm, and damaging a Police car on Saturday.

Bean admitted assaulting P.c. Steven Cosham, causing injuries for which the officer is still out of work.

Bean, of 27 Angle Street, was fined $500 for resisting arrest and $800 for causing $450 damage to the car.

Crown counsel Leighton Rochester told the court P.c. Cosham approached Bean on Church Street because of loud music coming from his car on Saturday.

The officer discovered that there was a warrant for Bean's arrest for non-payment of a speeding fine.

Bean became hostile and a violent struggle ensued. During the struggle, Bean grabbed the officer around the neck and wrestled him to the ground.

After Bean was sentenced, Ms Anderson returned to the court and asked Mr.

Warner to stay the immediate imprisonment, on the grounds that it was "harsh and excessive''.

Bean's mother interceded, saying: "It is a first offence and I thought it might be taken into consideration.'' Mr. Warner agreed to the appeal, adding: "Mr. Rochester, I must be a nice guy!'' Also yesterday, 54-year-old Wallace Chandler pleaded not guilty to attempting to aid Bean to escape custody, violently resisting arrest, and assaulting a Police officer.

The Friswell's Hill, Pembroke resident was freed on $1,000 bail. He is scheduled to return to court on May 11 for mention.
