For the second charge he was released on $500 bail and is scheduled to return to court for trial on May 8.

Crown counsel Charmaine Smith told the court that Police saw two men sitting in a private car on the south side of Elliot Street at 5.10 a.m. on May 7.

On their approach, they noticed Gibbons appeared nervous and was sweating.

Police searched him, but found nothing on him.

However, on searching the vehicle, Police found a Marlboro cigarette box containing a twist with a rock inside.

At first, Gibbons denied knowledge of the twist, but later admitted the rock was his.

He also identified the substance as crack.

Gibbons was taken to Hamilton Police Station where the rock was found to be 0.03 grams of free base cocaine of 79 percent purity and with a street value of $50.

Acting Senior Magistrate Archibald Warner ordered Gibbons to pay a $500 fine.
