Man denies sexually assaulting ex-lover

A Supreme Court jury was yesterday told a woman was forcibly taken to her ex-boyfriend?s home and sexually assaulted.

The alleged victim told the five-woman, seven-man jury that she and the 24-year-old accused had broken up in December of 2003, but still remained in close communication up to May 26, 2004, the date of the alleged assault.

The man, represented by lawyer Elizabeth Christopher, denies three charges including unlawful assault occasioning bodily harm, depravation of liberty and the sexual assault charge.

According to the woman?s testimony, her ex-boyfriend had called her several times that day to find out her whereabouts, but then grew angry after he heard the sound of two male voices in the background.

?He was still upset and accused me of double dating. So I hung the phone up,? she said, adding that he called her again and the two argued for 20 minutes to half an hour.

According to her testimony, she was out at Harbour Nights that night and arrived home to an empty fridge. She tried to leave her home to get something to eat when she ran into the accused, who was standing outside her front door, and proceeded to hit her on the side of her head, knocking off her helmet.

She told the court she was ?scared and shocked? by his actions, and said her ex-boyfriend began to choke her before dragging her into the bedroom where they proceeded to fight.

?We continued to fight. I kept trying to kick and push him off me and he knocked me in the with his hand,? she said adding: ?When he backed off I sat up and pulled my hands around my nose and saw that I was bleeding?.

She explained he later dragged her to his car at which point she had given up fighting him.

She said the St. David?s man then took her to his home and raped her.

She told the court that she did not consent to having sex and laid there staring at him. ?I didn?t want to provoke him and I shut myself down. I didn?t say anything. I didn?t move ? anything. I didn?t want to have sex with him at all.?

She claimed he then tried to sodomise her, but she stopped him.

She said that after she was raped she waited for him to fall asleep, but ended up falling asleep too. When she awoke close to 7 a.m. she quickly grabbed her things and left his house on foot.

She said she called for someone to pick her up and after her brother arrived they filed a report at the Police Station and then went to the hospital where she received medical attention.

During cross-examination, the woman admitted she had sexual relations with the accused after the alleged rape and also confirmed that the accused and herself had a ?tempestuous relationship? and that she hit him on several occasions.

The case continues today.
