Fines for employer and woman for illegal working

A Portuguese national caught working illegally at the Grand Atlantic Development was fined $500.Maria Pacheco appeared in Magistrates’ Court alongside the South Shore Warwick property’s manager, Dennis Rodrigues.Rodrigues, of So Far Lane, St George’s, pleaded guilty to unlawfully employing the 42-year-old.Pacheco, of Chapel Road, Paget, admitted to being unlawfully engaged in gainful employment between a date unknown and August 23, 2012.She told Magistrates’ Court she cleaned the showroom apartments at the Government housing site during that time.Lawyer Peter Sanderson said Pacheco has lived on the Island with her husband Francisco Aguiar, for ten years.Her husband, who is not charged with any offence, is the legal holder of a work permit for Grand Atlantic builder GL Construction.At the time of the offence, Pacheco had permission from the Department of Immigration to seek employment on the Island but was not the holder of a valid work permit.Crown counsel Geoffrey Faiella said that Pacheco, a mother-of-two who was struggling with medical expenses, had been offered work tidying up the development by 49-year-old Rodrigues.An arrangement was subsequently made by Rodrigues for GL Construction to pay her.Immigration officials were told of the deal on August 23 and on their arrival noticed Pacheco on the site, carrying a bucket.Under interview she admitted working, and said she had permission to look for a job, but hadn’t yet been granted a permit.“This is simply a case of one person working a few days, and it was a silly mistake to make,” Mr Sanderson told the court. “She had permission to seek work, and could have applied for it. This is not a case of someone who was here illegally in Bermuda.”Senior Magistrate Archibald Warner fined Rodrigues $2,000 for offering Pacheco work. He fined Pacheco $500 for working illegally.
