Alleged victim admits shenever called for help

A woman allegedly taken from her home and sexually assaulted by her ex-boyfriend admitted in Supreme Court yesterday that she made no attempt to call for help during the alleged ordeal.

"I suggest to you that at no time ? either at his house or your house ? did you make any call for help. I suggest to you that when you were alone in his bathroom with your cell phone you made no attempt to call for help," lawyer Elizabeth Christopher said to the woman during cross-examination.

The alleged victim agreed to both of these statements and also stated to the five-woman, seven-man jury that she gave no sign of disagreement with sexual intercourse.

"When (the accused) moved your underpants, you showed no sign you disagreed," said Ms Christopher, which the alleged victim agreed.

Ms Christopher, represents the 24-year-old St. David's man who denies unlawful assault occasioning bodily harm, depravation of liberty and sexual assault, for an incident on May 26, 2004.

The woman and her ex-boyfriend had broken up in December, 2003.

The woman earlier gave testimony that an argument had broken out with her ex-boyfriend over the phone on the night of the alleged assault while she was at Harbour Nights. He showed up at her house later and hit her on the side of her head, knocking her helmet off and the two continued to fight inside her house.

The woman said she received a bloody nose and a scratch on the face and then alleges she was forcibly taken to his home and raped.

The woman admitted to the Court that she showed no signs of disagreement while having sexual intercourse with her ex-boyfriend.

Ms Christopher said: "I would suggest to you that the behaviour of (the accused) at his house, prior to the sexual intercourse, was gentle. I would suggest to you that (he) gently guided you towards the bathroom. And there he turned on the light and tried to clean your nose with a wet piece of toilet paper."

The woman agreed to the statements and told Police in her statement she didn't speak because she was "angry".

The trial continues today.
