Woman wanted to give ex-boyfriend ?a second chance?

A woman who was allegedly taken from her home and sexually assaulted by her ex-boyfriend told the court she continued to have sex with him after the incident because she wanted to give him a ?second chance?.

?I had forgiven him and wanted to give him a second chance,? the woman said, when questioned by Crown counsel, Carrington Mahoney.

Her ex-boyfriend, a 24-year-old St. David?s man, represented by lawyer Elizabeth Christopher, has denied charges of unlawful assault occasioning bodily harm, depravation of liberty and sexual assault for the May 26, 2004 incident.

While the woman and the accused had broken up in December, 2003, she told the five-woman, seven-man jury they resumed sexual relations from November, 2004 until April, 2005.

The woman also admitted she had never called for help on the night of the alleged assault, and said: ?I was afraid he would have come and taken the phone from me.?

According to earlier testimony, the woman said she had an argument over the phone with her ex-boyfriend. She alleges that he then showed up to her house and hit her on the side of her head, knocking off her helmet, choked her and knocked her in the nose, causing it to bleed.

The woman told the court he also forcibly took her to his home and raped her.

Mr. Mahoney asked the woman why she showed her ex-boyfriend no sign of disagreement to sexual intercourse and she said: ?I was afraid of provoking him?.

A registered nurse for the Department of Health, Judith Brewster-Minors medically examined the woman on May 27 shortly after 12 p.m.

Ms Brewster-Minors gave testimony that the alleged victim had her saliva and blood examined in addition to being tested for possible semen and debris.

?I documented the appearance of the complainant (who was) just casually dressed with a few blood stains to the white pants she was wearing.

?There were many scratches, abrasions to the front and back of her neck and facial (area),? said the nurse.

Also giving testimony was Det. Con. Garic Swainson, who described the events leading up to the arrest of the accused.

When Officers approached him at his work place he showed no signs of resisting the arrest, said D.c. Swainson, who added: ?(The accused) implied to me that something went down between him and his girlfriend ? but it was not that serious.?
