The court heard from Crown counsel Paula Tyndale that on October 20, Manuel Tavares, who does not speak English, of St. George's, was stopped by Police in Hamilton Parish for suspicious driving.

The Police noticed him wobbling and weaving into the oncoming lane on two occasions. When the Police stopped him he had difficulty putting the bike on the stand and told the officer: "Yes, I had five drinks."

Tavares was told he was being arrested for impaired driving but then said to the officers: "I do not speak English."

At the Police station an interpreter was provided and after analysing his breath, it was discovered that Tavares had a minimum of 212 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80 milligrams of alcohol in 100 millilitres of blood.

Tavares was unable to understand the charges put before him as there was a language barrier and the court was forced to find a translator.

After a translator was located and the charges were reread in Portuguese, Tavares maintained his guilty plea and was fined $1,000 and 10 demerit points.
