Boys had sex with girl, 11, jury hears
Three boys aged 13, 15 and 16 had oral sex and then full intercourse with an 11-year-old girl, a jury heard.
The youngster, now 12, claims she told the boys "no" before the sexual encounters at the home of the oldest boy, Mr. A, last year.
He alone now stands charged at the Supreme Court with having unlawful carnal knowledge of the girl, Miss X.
None of the parties can be identified for legal reasons.
Miss X told the jury yesterday that she lived with her grandmother at the time and knew Mr. A as a neighbour. A couple of weeks before the alleged incident she said, he asked her to kiss him and have oral sex with him.
She said she told the boy 'no' and then alleged he bet her $10 to perform oral sex. "I told him no, I had to go home, and he kept pulling on my arm and I left," Miss X told the court.
On a Saturday night around two weeks later, she said, the 15-year-old in question called her up and she met him outside her home around 9 p.m. He was with Mr. A and the 13-year-old boy, and Mr. A invited her to his house.
"I was walking to (Mr. A's house) and didn't really feel like doing nothing — I was scared," explained Miss X. She started to walk away but returned when one of the boys asked her to.
Mr. A then took her down to a cellar at his home, she claimed, and asked her to give him oral sex. She told him no, but he initiated this anyway and then left.
The 15-year-old then came into the cellar and also initiated oral sex with her, despite her protests, Miss X claimed.
He left, and a similar situation once again unfolded with the 13-year-old when he arrived in the cellar.
The girl went on to tell the jury that she came out of the cellar afterwards to an area nearby, where Mr. A told her to take her pants off.
"I told him no, I'm not going to do it," Miss X told the jury.
However, Mr. A put a condom on and tried to lay her on the ground before having sex with her as she tried to push him off, she claimed.
He left after she told him to stop but a similar situation allegedly then unfolded when the 15-year-old arrived. He also left after having sex with her despite her protests, with the 13-year-old subsequently arriving and doing the same.
Miss X said she had known Mr. A since she was around five years old. She had known the 15-year-old for a couple of months, and had been in contact with him prior to the alleged incident via computer messaging. She did not know the 13-year-old well.
In cross-examination, defence lawyer Elizabeth Christopher put it to Miss X that Mr. A had in no way suggested having sexual encounters with her on the date in question. She denied this.
Ms Christopher further alleged that the girl had not told the Police about an allegation of oral sex with the three boys in the cellar, and there was no mention of this in her Police statements.
Miss X replied that if this was not in her statement, she had still told a Police officer about it.
The court also heard brief evidence from Miss X's mother, who had custody of the girl until she was six years old. The mother explained that Miss X was living with her grandmother at the time of the alleged incident, and was also receiving counselling at that time.
Mr. A. denies having unlawful carnal knowledge, and the case continues.
