The court accepted new evidence presented which the defence said proved Mr. Simmons, 23, had not been driving the car when the actual offender gave the wrong name and a bogus address of Stadium Heights.

After Crown counsel Cindy Clarke accepted the new evidence, Puisne Judge Charles Etta Simmons ruled that Mr. Simmons? conviction be quashed and the case dismissed.

The court heard the evidence given by the Police officer in the trial had led to ?an honest case of mistaken identity?.

A driver who took to the road while banned has been criticised for showing the court ?contempt?. Dominic Butterfield was stopped by Police as he drove on Parsons Road, Hamilton, on November 11.

But Magistrates? Court heard last week how the 19 year old had already been barred from the road for one year in August for another motoring offence.

When Senior Magistrate Archibald Warner asked the defendant why he drove, the St. George?s resident replied: ?I can?t give you a good enough reason...just being disobedient, I guess.? Mr. Warner replied: ?You are treating this court with contempt. ?When you disobey your mother you get punished at home, but when you disobey this court you get sent to Westgate. Big difference, isn?t it??

Butterfield, of Ferry Close, admitted driving while disqualified. He was fined $1,000 and banned for an extra three months.

A 51-year-old Warwick man appeared briefly in Magistrates? Court recently on charges of sexual assault. The man, who can not be identified for legal reasons, is accused of sexually assaulting a minor between January 2002 and May 2005.

He will return to court on March 22 for trial and was released on $5,000 bail with one surety.
