Young appeared in Magistrates' Court yesterday in the orange remand uniform and explained that he had been accused of robbing Somerset Post Office.

When asked about the heroin charge, he said: "I was just walking through a playground when the Police stopped me and searched the area and found drugs in the area and I was arrested. But the drugs didn't belong to me.'' Magistrate Edward King cleared him of the charge after Crown counsel Leighton Rochester admitted Police were not in a position to proceed with the trial five months after Young had last appeared in court to answer the charge.

Mr. King said: "This is an unsatisfactory state of affairs. Something is wrong in the state. I dismiss the case for want of prosecution.'' CYCLE SHOP TO MOVE BUC Cycle shop to move World Distributors plans a new Pembroke location for its cycle sales showroom.

Plans are underway and a change of use form has been submitted to the Planning Department.

Some 5,400 square feet will be needed for the project.

In addition to the showroom offices, there will be an area for spare parts sales and an area for workshop in the Buttery Building.

There will also be a secured caged cycle area for storage of repaired cycles.

The proposed move is to take place on January 1, 2000.

VISITORS FINED FOR DRUGS CTS Visitor fined for drugs An American visitor yesterday learned that using illegal drugs to help him sleep and alleviate pain can be costly in Bermuda.

John Roxburgh, 43, of New York state pleaded guilty in Magistrates' Court to possession of cocaine with a street value of $2,000 and possession of drug equipment, consisting of two pipes, two spoons, three knives, four glass bottles, one razor and one metal platter on October 12.

Roxburgh arrived on the Island on October 11 on the cruise ship MV Zenith .

On October 12, Customs officers searched his cabin and found a brown vial containing .43 grammes, a black film case containing 4.69 grammes, and a cigarette case containing 2.79 grammes. Also .11 grammes of cocaine were found on the floor of the cabin.

When asked Roxburgh said the drugs were used to help him sleep and relieve pain due to certain injuries he had.

He stated that he did not want to go jail and that he would give his last dollar to pay the fine.

Magistrate Edward King fined him $900 for possessing the drugs and $600 for the drug equipment.

TEENAGER ASSAULTED CTS Teenager assaulted Police are investigating an "unprovoked'' attack on a 14-year-old Pembroke boy.

The victim told Police that he was passing by a pair of older boys sitting on a wall on St. John's Road in Pembroke on Wednesday when one of them began a verbal confrontation with him. He then grabbed the boy and threw him to the ground before hitting and kicking him in the face.

The boy received injuries to his right eye and cheek, but gave a description of one of the men to Police.

MAN DENIES CHARGE CTS Man denies charge A 29-year-old Sandys Parish man yesterday pleaded not guilty to possession of cannabis. Sean Saltus, of Spring Benny Road, was charged in Magistrates' Court with possession of 1.72 grammes of cannabis on April 30.

Saltus will return to court on February 22 to stand trial.
