Prosecuting, Police Sgt. Earl Kirby said Burgess was initially arrested in the early hours of July 23, when Police found him throwing karate kicks by the side of Mullet Bay Road in St. George's.

Sgt. Kirby said: "He was unable to speak properly and could not balance. He was obviously drunk.'' He was arrested and bailed out of the Police station at 7.30 a.m. Three hours later Police received a complaint from the Somers Supermarket, in York Street.

They heard that Burgess had caused a disturbance. Police warned him not to repeat the behaviour.

At 10 p.m. on the same day, Police were again called to the supermarket. Sgt.

Kirby said: "He had an argument with the store clerk and officers assisted him from the premises. He was obviously intoxicated.'' Burgess swore at the Police officers and lashed out at them, so he was again arrested.

He told the court: "I remember nothing. I do remember being arrested the first time and speaking to the supermarket clerk.'' Sgt. Kirby said that Burgess had a history of alcohol-related offences. He had been receiving treatment but when a recent period of bail ended he had stopped.

Mr. Francis asked Burgess: "What are we going to do about your alcohol problems? Do you want to be arrested for making a nuisance of yourself again? "You have been given fines and conditional discharges, and you have been put on probation. When you left probation you appear to have left everything.

"One of these days you are going to get a stiff prison sentence. This time I am going to suspend it.

"You must realise that you are right up against the prison doors. The first time you put a bottle to your mouth and start acting the fool those prison doors are going to open and you will be inside.'' Mr. Francis sentenced Burgess to three months in prisons, suspended for a year.

He added: "You better face it, just a spoonful of liquor is going to take you over the top. The only thing that is going to stop you is the threat of prison. This is your last chance to take a hold of yourself.''
