DPP: Lewis guilty even if he didn’t land fatal blow

Defence lawyer John Perry QC was today accused of attempting to retry a manslaughter conviction, in the Court of Appeal.The claim was made by Director of Public Prosecutions Rory Field on the second day of an appeal by teenager Kellan Lewis.Lewis was convicted last year of manslaughter and possessing a bladed article in connection with the killing of 18-year-old Kellon Hill.Mr Hill was leaving a party at Elbow Beach when he was attacked by a group of teenagers and fatally stabbed in August, 2008.Five people were charged in connection with the attack, but Lewis alone was convicted.Mr Perry yesterday argued that the only evidence against Lewis was the testimony of a single witness, who he described as unreliable.Today, Mr Field insisted that two people reported seeing Lewis with a knife the evening of the attack.He said that even if Lewis had not landed the fatal blow himself, his involvement in the fight aided the killer.“The punching and kicking clearly gave support to someone else who was also attacking,” Mr Field said. “They would feel safer in making that attack because someone else was there attacking.“Though Mr Hill was a quiet boy, a church boy, he could defend himself.”Mr Perry maintained two factors were necessary for Lewis to be convicted of manslaughter without landing the fatal blow he would have to know about the knife and have the intent to use it to cause unlawful force and aid the offence.Mr Field countered that merely knowing about the possibility of unlawful force and aiding would make Lewis guilty.
